What happens if you die without a will in the UAE?

When a UAE resident dies without a registered will, three things happen: their UAE bank accounts are frozen until inheritance proceedings conclude, their estate is distributed under fixed statutory rules rather than their wishes, and a court — not the family — decides who becomes their children's guardian.
None of this is hypothetical. It is the default legal machinery, and it runs the same way whether the estate is large or small.
The bank accounts freeze first
Banks in the UAE freeze a deceased customer's accounts once notified — including joint accounts in many cases. Day-to-day money a family relied on becomes inaccessible until the court process concludes, which can take months. Salaries stop; the accounts holding them lock.
Fixed rules decide who gets what
Without a registered will, your estate is distributed under the applicable statutory inheritance rules — a fixed formula that may look nothing like what you would have chosen. A surviving spouse, for example, does not automatically receive everything.
Since 1 January 2026, under Federal Decree-Law No. 51 of 2024, if no heirs can be identified, assets can be transferred to a state-managed charitable endowment.
Guardianship goes to the court
For children under 21, a court decides who raises them. The person the court appoints may not be the person you would have chosen — and relatives abroad may face a long process to be recognised. A registered will is where you name both an interim guardian (someone in the UAE who can act immediately) and a permanent one.
Property and shared assets get stuck
Jointly owned property doesn't simply pass to the co-owner. The deceased's share enters the estate and follows the same statutory process, leaving the survivor unable to sell, refinance, or sometimes even fully use the asset until proceedings finish.
The fix is administrative, not dramatic
All of the above is avoided by registering a will — for most people, a guided form, a court fee, and a short video call with the court's notary. The estate then follows your written wishes instead of the default formula.
