UAE inheritance rules for expats — the 2026 picture

The single most important fact about UAE inheritance for expats: the default is a fixed statutory distribution, and 'my spouse gets everything' is NOT the default. A registered will is the instrument that replaces the formula with your own wishes for your UAE assets.

The default machinery

When a resident dies, their UAE bank accounts are frozen pending proceedings, and the estate is distributed under the applicable inheritance rules — a share-based formula among family members. For families used to common-law expectations (surviving spouse takes all), the formula's results can be a shock: a spouse shares with children, and sometimes with the deceased's parents.

What changed for non-citizens

The UAE has built a civil personal-status framework for non-citizens, running alongside the Sharia-based system, with Abu Dhabi's civil family court at the front of it. Under it, a non-citizen can make a civil will electing their own distribution — and under ADJD's current guidance this is open to non-citizens regardless of religion.

Since 1 January 2026, Federal Decree-Law No. 51 of 2024 also provides that where no heirs can be identified, assets can pass to a state-managed charitable endowment — one more reason unclaimed, will-less estates are worth avoiding.

What a will does and doesn't control

  • Controls: your UAE assets — accounts, property, vehicles, investments, end-of-service — and guardianship of your children under 21.
  • Doesn't control: assets in other countries (their local law governs — see our foreign-assets guide), and insurance payouts where the policy has its own beneficiary nomination, which is applied first.

The practical takeaway

If you're a non-citizen with anything or anyone you care about in the UAE, the question isn't whether rules will apply on your death — they will. It's whether they'll be the default formula or your written wishes. Moving from one to the other is, in 2026, an online process measured in days.
